# Zastrzeżenie TDM
# Wydawnictwo Naukowe PWN S.A. oraz jej jednostki powiązane w ramach grupy kapitałowej, tj. ePWN Sp. z o.o. oraz OSDW Azymut Sp. z o.o.  („Grupa PWN”), działając na podstawie art. 4 ust. 3 Dyrektywy Parlamentu Europejskiego i Rady (UE) 2019/790 z dnia 17 kwietnia 2019 r. w sprawie prawa autorskiego i praw pokrewnych na jednolitym rynku cyfrowym oraz zmiany dyrektyw 96/9/WE i 2001/29/WE (Dz. U. UE. L. z 2019 r., nr 130) (DSM) oraz art. 26(3) ust. 1 i 2 ustawy z dnia 4 lutego 1994 roku o prawie autorskim i prawach pokrewnych (Dz. U. 1994, nr 24, poz. 83 ze zm.), niniejszym zastrzegają (nie wyrażają zgody) na jakąkolwiek eksplorację lub zwielokrotnianie tekstów i danych (TDM) dostępnych online i/lub w formie cyfrowej, do których uprawniona jest  Grupa PWN (dalej łącznie: „Treści”), w tym w tym w zakresie wykorzystywania lub przechowywania Treści. Powyższe zastrzeżenie dotyczy wszelkich Treści, w tym tekstów, danych, materiałów graficznych, fotograficznych, audio i video, baz danych i programów komputerowych oraz przedmiotów praw pokrewnych, w szczególności artystycznego wykonania, dostępnych online i/lub w formie cyfrowej, w tym na stronach internetowych, serwisach i w aplikacjach Grupy PWN.  Zakres zastrzeżenia obejmuje wszelkie formy eksploracji Treści, w tym przy zastosowaniu zautomatyzowanych technik, których celem lub rezultatem jest wygenerowanie informacji obejmujących między innymi wzorce, tendencje lub korelacje, a także wykorzystujące technologie sztucznej inteligencji, w tym uczenia maszynowego lub typu generatywnego.
# Zastrzeżenie nie dotyczy eksploracji Treści dokonywanej w celu ustalenia pozycjonowania stron internetowych w ramach indeksowania wyników wyszukiwania wyszukiwarek internetowych, a także nie wyłącza ani ogranicza uprawnień wynikających z umowy lub bezwzględnie obowiązujących przepisów prawa, które nie mogą zostać wyłączone treścią niniejszego zastrzeżenia, w szczególności w odniesieniu do konsumentów.

# Wydawnictwo Naukowe PWN S.A. and its affiliates within the capital group, i.e. ePWN Sp. z o.o. and OSDW Azymut Sp. z o.o.  (“PWN Group”), acting pursuant to Article 4(3) of Directive (EU) 2019/790 of the European Parliament and of the Council of 17 April 2019 on copyright and related rights in the Digital Single Market and amending Directives 96/9/EC and 2001/29/EC (OJ EU. L. 2019, No. 130)  (DSM) and Article 26(3) sec. (1)-(2) of the Act on Copyright and Related Rights as of 4 February 1994  (Journal of Laws 1994, No. 24, Item 83, as amended), hereby reserve (do not consent) to any extractions and reproductions of the texts and data (TDM) available online and/or in digital form to which the PWN Group is entitled (collectively:  the “Content”), including with respect to use or storage of the Content. The above reservation applies to all Content, including text, data, graphic, photographic, audio and video materials, databases and computer programs, and objects of related rights, in particular artistic performance, available online and/or in digital form, including on the PWN Group's websites, services and applications. The scope of the reservation includes any form of the Content mining, including using automated techniques that have the purpose or result of generating information including, but not limited to, patterns, trends or correlations, and using artificial intelligence technologies, including machine learning or generative type.
# The reservation does not apply to the Content mining performed for the purpose of determining the positioning of websites as part of the indexing of search engine results, and does not exclude or limit contractual rights or mandatory laws that cannot be excluded by the content of this reservation, particularly with respect to consumers.
